The Indore Bench of the Madhya Pradesh High Court has delivered a major verdict in the long-running Bhojshala and Kamal Maula Mosque dispute in Dhar. In a significant decision, the court recognised Bhojshala as the Vagdevi Temple and said the Hindu side should be allowed to perform worship at the site.

The High Court also handed over the responsibility of preserving and managing the complex to the Archaeological Survey of India (ASI). The court stated that the verdict was based on a detailed examination of the ASI survey report, historical documents, inscriptions, architectural remains, and other evidence submitted during the hearings.

While announcing the verdict, the court observed that the Bhojshala complex holds both religious and historical significance. It further stated that protecting historical and religious monuments is the constitutional responsibility of both the state and central governments. The administration has also been directed to provide basic facilities for devotees, maintain law and order, and ensure the protection and sanctity of the site.

ASI Survey Report Becomes Key Evidence in Bhojshala Case

The Madhya Pradesh High Court said the ASI’s scientific survey and archaeological findings played a major role in the final judgment. During the proceedings, the Muslim side had raised objections to the ASI survey report and its conclusions. However, the court accepted the report as a crucial part of the official record.

The double bench stated that it carefully reviewed the ASI findings, structural remains, inscriptions, and historical records before delivering the judgment. The court also noted that the archaeological and historical importance of the Bhojshala complex could not be ignored.

Hindu Side Presented Historical Evidence on Bhojshala Temple Claim

During the hearings, the Hindu side argued that Bhojshala was originally an ancient temple dedicated to Goddess Saraswati. To support the claim, several historical references, architectural details, and religious documents were presented before the court. The court considered these arguments along with the ASI findings while reaching its decision.

The legal battle intensified in 2022 after Hindu Front for Justice filed a petition in the High Court. The petition sought a clear declaration regarding the religious nature of Bhojshala and demanded complete worship rights for the Hindu community.

Following the court’s order, the Archaeological Survey of India conducted a 98-day scientific survey of the Bhojshala complex in 2024. After the survey report was submitted, both sides presented detailed arguments based on the findings before the High Court delivered its final verdict.
