Delhi HC excludes Sunjay Kapur’s sister from will

New Delhi: The Delhi High Court has approved a fresh application by Priya Kapur to remove the name of her late husband Sunjay Kapur’s sister, Mandhira Kapur, from the court order in ongoing proceedings related to Sunjay’s purported will.

Justice Jyoti Singh granted Priya’s plea seeking rectification of a September 10 order, which had mistakenly recorded Mandhira’s appearance despite her neither being a party to the suit nor requesting to be heard.

The application, filed under Sections 151 and 152 of the Code of Civil Procedure, highlighted that Mandhira Kapur was wrongly mentioned as present during the hearing. The court noted that senior advocate Geeta Luthra and others appeared on behalf of Mandhira during the hearing. However, Luthra subsequently clarified that Mandhira was not a party to the case and had neither filed any plea nor was represented by anyone in the matter.

Priya’s application contended that including Mandhira’s name in the proceedings created a misleading record. Senior advocate Rajiv Nayar, representing Priya Kapur, argued that this was “an attempt by Mandhira to gain backdoor entry into the case.”
