Federal prosecutors at the US Department of Justice have initiated steps to dismiss criminal fraud and bribery charges against India’s billionaire and Asia’s richest man, Gautam Adani, marking a stunning reversal in a case that had sent shockwaves through global financial markets.

The decision to end the prosecution comes less than a year after he was indicted for what the US authorities allege role in a multi-hundred-million-dollar bribery scheme intended to secure lucrative solar energy contracts in India.

The move, widely seen as a significant shift in US enforcement priorities under the current  Trump administration, effectively clears a major legal hurdle for the Adani Group’s international expansion.

In an undisclosed April meeting at the Justice Department, Trump’s personal lawyer overseeing the billionaire’s case, Robert J Giuffra Jr, said that his defendant would invest $10 billion in the US economy that would create 15,000 jobs if the US prosecutors dropped the charges against him, according to the New York Times.

A Dramatic Shift in Federal Prosecution

The US Department of Justice filed a motion in a Brooklyn federal court to dismiss the indictment against Adani, his nephew Sagar Adani, and other executives. The original charges, filed in late 2024, alleged that the defendants had conspired to pay over $250 million in bribes to Indian government officials while misleading US investors to raise billions in capital.

The US government’s decision to drop the case follows a comprehensive review of the evidence and a change in “prosecutorial discretion” following the transition in Washington.

Political Context

The dismissal has sparked intense debate regarding the intersection of politics and the US legal system. The move coincides with a period of warming relations between US President Trump and Indian Prime Minister Narendra Modi, with whom Adani is closely allied. Sources suggested that the Trump administration’s willingness to drop charges against high-profile international figures may be linked to broader strategic goals, though the US Department of Justice maintained that the decision was based solely on the merits of the ongoing litigation.

Markets React

Financial markets responded immediately to the development, with shares in Adani Group companies surging on the Bombay Stock Exchange. The removal of the US legal cloud is expected to restore investor confidence and allow the conglomerate to resume its aggressive pursuit of global infrastructure projects.

“This is a massive victory for the Adani Group and a validation of their stance that the charges were politically motivated,” an analyst told The South China Morning Post.

However, some transparency advocates warn that dismissing such a high-stakes case could undermine efforts to combat corporate corruption.

Legal and Regulatory Hurdles

While the criminal case in New York is nearing its end, the Adani Group still faces various civil inquiries and regulatory scrutiny in other jurisdictions. The US Securities and Exchange Commission (SEC) has not yet clarified whether it will continue its parallel civil litigation against the executives. Despite the criminal reprieve, legal experts note that the reputational damage from the initial indictment may still affect the group’s ability to secure financing from Western institutions that adhere to strict environmental, social, and governance (ESG) standards.
