Jess Asato, a UK Labour Party member, claims someone used Grok to make fake photos of her in a bikini without her consent in January. This came after she criticized deepfake porn online. So not only is her image being misused, but it might’ve been targeted because of her outspoken views on the topic.

Jess Asato submitted her claim to London’s High Court, where she accuses xAI of misusing private info under the Data Protection Act. Not only does she want compensation, but Asato also aims for this case to establish that AI devs can be held responsible for their systems’ design and use.

Asato shared how the fake images affected her emotionally. She pointed out that no one can walk up to her in public and undress her or put her in a bikini, so she thinks it shouldn’t be okay online either. Asato added it feels like digital stripping, even if it’s not exactly the same, because it happened without her consent. Finally, she hopes others in similar situations will support her case or start taking legal action themselves.
Deepfake Pornography Concerns and AI Regulation
This case follows growing worries worldwide about deepfake porn and the harmful use of AI to make non-consensual sexual content. In January, xAI said they’d stop Grok from editing pictures of actual people to remove clothing.
UK Law on Non-Consensual Deepfake Images
The UK introduced a law last year making it illegal to create or request non-consensual deepfake images of adults. However, Asato argues that companies should still be held responsible for harm caused before such protections were enforced.
Asato said, “Once the damage is done, the damage is done. If you think about any other products, like a car, for example, that might have been manufactured with a fault, it doesn’t matter if, you know, the cars get recalled and the faults are fixed and no more harm is done.”
