Deborah Boardman, U.S. District Judge in Greenbelt, Maryland recently passed a preliminary injunction to block the latest executive order from President Trump regarding birthright citizenship. Judge Boardman slammed Trump’s latest executive order & passed the preliminary injunction at the request of an immigrants rights advocacy group.
She said that the order “is almost certainly unconstitutional as applied to the certified class for the simple reason that the Supreme Court in Barbara already decided that the children in the class are citizens at birth”. Judge Boardman then added that “This Court must, once again, preliminarily enjoin enforcement of the President’s most recent attempt to strip the right to citizenship from them.”
What was the New Executive Order?
President Trump’s latest executive order aimed to target what he described as “birth tourism”. Under the new order, the administration sought to prevent federal agencies from recognising US citizenship for certain children born in the country if their parents fell into specified categories. It covered cases where the parents of the American born were – An “alien enemy” under US law, An employee of a foreign government or certain international organisations or involved in arrangements intended to obtain US citizenship for the child through birth tourism or similar commercial arrangements.

Previously, the US Supreme Court also ruled in favour of the Birthright Citizenship Act. at the time, Trump denounced the SCOTUS ruling and promised to introduce a new legislation regarding the matter.
After that, on August 6, Trump signed a fresh executive order that reduced the extent of his previous plan. The directive aimed to refuse citizenship papers to some children born in the United States if neither parent holds US citizenship and one parent is an ‘alien enemy,’ works for a foreign government, or is engaged in a business deal or fraud tied to acquiring birthright citizenship.
Now, his latest order has been struck down. And Maryland’s Judge Boardman hailed the Supreme Court’s ruling from June in the hearing.“The Supreme Court has spoken: Children in the certified class are ‘citizens at birth’,” she stated.
Birthright Citizenship Act: Main Controversy Explained
Ever since its introduction, the Birthright Citizenship Act has garnered controversy. But why? The proposed act is in direct violation of the American Constitution’s 14th Amendment, which explicitly grants citizenship to anyone born on U.S. soil, regardless of his/her parents’ status.
