Kathy Hochul: New York Governor Slams DA Over Handling Of Cornell Rape Allegations, Appoints Special Prosecutor

Hochul's rebuke reflects growing political pressure on law enforcement for inadequate responses to elite institution sexual assault cases, coinciding with criticism from US Representative Alexandria Ocasio-Cortez regarding systemic failures protecting rapists at Ivy League universities.

New York Governor Kathy Hochul has sharply criticised Tompkins County District Attorney Matthew Van Houten for failing to conduct an independent criminal investigation into allegations that seven Cornell University fraternity members sexually assaulted a woman in October 2024. The governor’s public rebuke targeted what she characterised as prosecutorial negligence enabling sexual violence to proceed unpunished within elite educational institutions.

Hochul stated that the district attorney’s office had abdicated its fundamental responsibility to thoroughly investigate credible sexual assault allegations, instead relying upon incomplete information and failing to pursue independent evidence examination. The governor emphasised that professional prosecutorial obligations require rigorous investigation regardless of institutional pressures or claims of investigative burden.

The woman, referred to as Jane Doe in legal filings, alleged that she was drugged with ketamine and sexually assaulted by multiple men at the Chi Phi fraternity house on 19 October 2024. A Snapchat message documented by the lawsuit purportedly showed fraternity members posting “free p—y” in a group chat, allegedly soliciting participation in the assault.

Kathy Hochul: What Specific Prosecutorial Failures Did Hochul Highlight?

Governor Hochul criticised Van Houten’s admission that his office never independently examined the allegations or conducted a thorough criminal investigation before declining to prosecute. The district attorney subsequently conceded that he had not independently reviewed evidence, instead deferring to Cornell University’s Title IX investigation and early police assessments.

The prosecutor acknowledged in his September 28 announcement that his office would present evidence to a grand jury only after the civil lawsuit compelled public reconsideration of the case. This reactive posture, investigating only after civil litigation forced the issue, exemplified what Hochul characterised as institutional failure enabling sexual violence to persist within universities.

Kathy Hochul: How Does This Case Reflect Broader Failures Protecting Assault Victims At Elite Institutions?

US Representative Alexandria Ocasio-Cortez condemned what she called a “culture of rape” protected within elite institutions, noting that fraternity members had documented their alleged assault through group messaging accessible to prosecutors and police. The fact that explicit incriminating evidence existed yet remained insufficiently examined by law enforcement suggested systemic indifference to assault allegations against affluent, educationally privileged perpetrators.

Governor Hochul’s condemnation reflects growing political consensus that prosecutorial offices routinely fail sexual assault victims by declining to conduct thorough investigations, particularly when alleged perpetrators possess institutional privilege or educational pedigree. The Cornell case exemplifies how prosecutorial discretion, ostensibly protecting alleged perpetrators’ rights, instead protects privileged institutions from accountability.
