According to the statement from one of Hearn’s lawyers, Steve Hevin ‘‘All options are on the table”. Levin added that his client “has a number of potential remedies” against the prosecutors that indicted him with options including “civil suits, bar referrals for the prosecutors involved, request for sanctions, and reimbursement of attorneys’ fees and expenses”.
When the criminal charges against Hearn were originally dropped, the legal team lashed out at the Donald Trump administration. “The Trump administration’s case against David Hearn should never have been brought. “Its dismissal today does not erase the abuse of government power in arresting and charging a patriotic American who did nothing wrong.” the team said in a statement at the time. A few days ago, the office of US attorney Jeanine Pirro moved to dismiss all criminal charges against David Hearn, an Olympian who faced indictment for his role in the alleged vandalism of the reflecting pool at Lincoln Memorial. In the filing document sent to court, Pirro acknowledged that the charges against Hearn were not substantiated.
“The damage was the result of a botched installation and not vandalism, as initially represented by [the Department of the Interior],” Pirro stated. She realised the same while going through documents shared by the Department of Interior.
Pirro then added that “It was not until after these documents were produced,” and her office “first became aware of information showing that the damage was the result of a botched installation and not vandalism as initially represented by DOI.”

Yes, according to the motion filed by Jeanine Pirro’s office the damage to the reflecting pool at Lincoln Memorial was caused by poor renovation, rather than vandalism.
The attorney acknowledged the same, stating “Damage to the Lincoln Memorial Reflecting Pool in June 2026 was the result of flawed installation by the contractor,”. She added that the pressure to finish the Reflecting Pool renovation project before the Independence Day holiday, was the reason behind the renovation’s failure.

Since the US Department of Justice has moved to drop all charges against David Hearn, the case will likely close. The new evidence ( described as “695 megabytes of additional documents” in the filing) clearly indicates that there was no vandalism and Hearn was merely trying to inspect the extent of the pool’s damage. The fault in this case lies with the contractor whose renovation work has been described as ‘hasty and botched’.
