Voters approved the resulting ballot measure in a special election, but Virginia’s Supreme Court ruled in May that Democrats had violated the state’s constitutional procedure by advancing the amendment while an earlier legislative election was still underway, since Virginia requires such amendments to pass twice, once before a legislative election and once after.
David Wasserman of The Cook Political Report described the setback as a significant blow to Democratic strategy nationally, telling PBS News that Virginia Democrats had been counting on the state to help offset redistricting gains Republicans had secured in Texas and Florida. Senator Mark Warner had signalled unease about the plan even before the court ruling, telling HuffPost at the time, “Whatever is being discussed is not being done in a context of isolation,” adding that the push would likely not have been considered at all had Republican-led states not moved first.

Democrats are also targeting a second Republican-held seat as part of their broader push to flip the net seats needed to reclaim the House majority in November.
