Allahabad HC summons Police Commissioner on contempt petition

Legally SpeakingAllahabad HC summons Police Commissioner on contempt petition

Mumbai: The Allahabad High Court has recently summoned Prayagraj Police Commissioner Tarun Gauba and other officials to appear on December 10 regarding a contempt petition.
The court has demanded an explanation on actions taken against policemen who delayed registering an FIR despite a complaint from the petitioner.
Justice Salil Kumar Rai, while hearing the contempt plea filed by Balram Yadav, scheduled the next hearing for December 10. The petitioner alleged that the delay in filing the FIR violated established court guidelines.
The case pertains to an incident on September 25, where Yadav’s father was allegedly attacked by Arpit, a representative of a local MLA. Yadav claimed political pressure prevented Ghurpur Police Station, Prayagraj, from registering the complaint promptly.
Previously, on November 28, the high court directed the Police Commissioner, DCP of Yamuna Nagar, and other officials to appear before it. They submitted an affidavit stating that an FIR had been registered based on Yadav’s complaint and that a preliminary inquiry into the responsible officer’s conduct had been initiated.
However, the court found the affidavit lacking, as it did not clarify whether any action would be taken against the officer in question.
Responding to this observation, the Additional Advocate General representing the state sought an additional week to file a comprehensive affidavit detailing the proposed actions.
