The Delhi High Court in the case All Residents Welfare Society (ARWS) v. Caelum Arpit Brand Technologies Private Limited And ors observed and has stated that felling of trees should be the last resort in national capital, thus, the court restrained the Delhi Development Authority and others from clearing of the land and felling of trees on a plot which is located in Vasant Kunj, New Delhi.
The bench headed by Justice Jasmeet Singh in its order stated that this court is of the view that this court is of the view that felling of trees should be the last resort. Therefore, if any other alternative site is being available, the same must be looked upon.
In the present case, the court was hearing the plea moved by All Residents Welfare Society seeking to restrain Caelum Arpit Brand Technologies Private Limited, the DDA and others from going ahead with the proposed Complex on the piece of the land. It has also been prayed in the plea for shifting the proposed complex to an alternative plot.
It has also been noted by the said court that the photographs show that the plot of land has become a biodiversity park with beautiful trees, the wildlife, birds, etc., and the court issued notice to the respondents.
The court while considering the facts and circumstances of the court stated that the respondent in the case is restrained from clearing of land and felling of trees on the plot comprised in Sector A Pockets B&C, Vasant Kunj, New Delhi.
Accordingly, the court listed the matter for further consideration on July 03, 2023.
