The Karnataka High Court in the case Dr Vinod G Kulkarni And Ministry of Railways & Others observed and has refused to grant any relief and has permitted the withdrawal of a public interest litigation wherein it seek directions to the Union Government to restore the concession in fare for senior citizens in Railways.
The division bench comprising of Chief Justice Prasanna B Varale and Justice M G S Kamal in the case observed and has stated that weather the concession should be given to a particular class, all these are policy issues and how the said court can enter that arena.
The petitioner, Vinod G Kulkarni in the plea stated that since 2020, the concession in fare has been discontinued and because of which senior citizens are suffering in the case a lot.
The bench in the case asked the petitioner if any request is being made by him in this regard to the Member Of Parliament. Thus, the court stated that there being the legislative ways they can do something, not by this way and if they are not being represented by the people they have every right to raise the issue before the appropriate forum.
Adding to it, the court stated that the representative of people is having other tools, these tools can be effectively used to raise the issue of public importance, thus, even who are protecting a class of citizens before appropriate forum. Therefore, if the said tools are properly being used and certainly there can be at least a redressal through the forum. Vinod G Kulkarni, the petitioner appeared in person CGC Kumar M N for the respondent.
